Booking Terms and Conditions – England and Wales
- Purpose
This policy sets out the payments required to Mys Living in order to secure a booking at one of our properties and the process to complete this booking.
Our aim is always to be clear and transparent about how to book a room with us, the costs involved and circumstances where either you or we can cancel a booking.
- Scope
This policy applies to all bookings relating to buildings in:
- England
- Wales
Mys Living’s Assured Shorthold Tenancy (AST) sets out the full terms and conditions applicable during the tenancy period. The AST is a legally binding document – if you do not understand these terms and conditions or the AST we advise you to seek advice prior to accepting your booking with us.
A separate policy and arrangements exist for rooms in buildings located in Scotland.
- Required Payments at Time of Booking
In order to book a room with Mys Living, a Holding Deposit is required which will not exceed 1 week’s rent. If you have paid a Holding Deposit, this will be treated as a payment towards your first rental payment and credited to your rent account upon check-in.
- Booking Deadline
The Booking Deadline is 7 day after the commencement of your booking. Your Booking must be completed in full, including payment of the Holding Deposit and acceptance of the Tenancy Agreement and Guarantor Documents where required.
Failure to complete your Booking within this timescale may result in your Booking being cancelled and your Holding Deposit being retained by us.
Mys Living reserves the right to reduce this Booking Deadline at its discretion; in all cases the deadline will be notified you prior to your Booking being cancelled.
- Cancellation of your Booking by Mys Living
Mys Living may cancel your Tenancy Agreement subject to any of the following:
- we take all reasonable steps to enter into the Tenancy Agreement before the Booking Deadline and you fail to do so or the Booking Deadline has passed. For example, if you fail to complete your application or provide guarantor details (if applicable) and supporting documentation;
- we believe that you have provided us with relevant false or misleading information;
- we are prohibited from entering to the Tenancy Agreement with you because of the Immigration Act 2014 (persons disqualified by immigration status). Should we cancel your booking for this reason, you will not be liable for the contractual obligations laid out in the Tenancy Agreement from the date of cancellation, irrespective of whether you have signed it;
- you or your guarantor (if applicable) fail to cooperate with any Screening Search Additional Information Request(s) or we have determined following undertaking Screening Searches that you or your guarantor (if applicable) appear on Sanctions Lists and/or Law Enforcement Databases;
- you have not paid any amounts that have fallen due (including but not limited to, your first rental instalment, any previous year’s rent or damage charges);
- you have committed any breach of the Tenancy Agreement or any previous tenancy agreement with us.
- Cancellation of your Booking by You prior to your Tenancy Start Date (No Place No Pay Guarantee)
Mys Living offers a guarantee that if you do not take up your place at your chosen University then you may be released from your Booking and the obligations under your Tenancy Agreement, subject to the following conditions being met:
- You are unsuccessful in gaining a place at your chosen University due to failure to obtain grades or a visa; and
- Evidence of such, for example a letter from the University, is provided within 5 days of it being received by you; and
- Your request is accepted and approved by Mys Living thus confirming the lifting of any liability on you.
In these case your Holding Deposit will be refunded in accordance with our refunds policy.
Where we cannot verify the authenticity of such evidence mys Living reserves the right to reject such a request and to enforce the terms and conditions of the Tenancy Agreement in full.
Should you wish to cancel your Booking for any reason not listed above or your request is not accepted by us, you will remain responsible for all the terms and conditions of the Tenancy Agreement. In certain circumstances it may be possible to find a replacement tenant to take over the obligations of your agreement, this will be managed in accordance with the mys Living tenancy assignment policy.
- Requests to Cancel of your Tenancy after the Tenancy Start Date
Where your Tenancy Start Date has passed and/or you have collected keys for the property, you may only Terminate your Tenancy Agreement with mys Living in the following circumstance:
- You no longer continue to be a student at your chosen University as a result of a medical condition which was not known to you at the time of commencing your tenancy, or;
- You no longer continue to be a student at your chosen University as a result of a family bereavement or circumstance which was not reasonably known to you at the time of commencing your tenancy.
In these circumstances you should make a request to the General Manager of your building in writing (via email) and include evidence of your stated reason(s) and your withdrawal from University.
All documentation and attachments must be received by us in English in order for us to consider your release from tenancy.
Upon acceptance, your tenancy release will be valid from the date 2 weeks after the approval has been submitted to us or 2 weeks after your release date from University, whichever is the latest.
Submission of a request and associated documentation is not a guarantee that your tenancy release will be approved and you will remain responsible for the terms and conditions of the Tenancy Agreement in full until the date your release becomes valid.
In all circumstances a replacement tenant may be identified to take over your tenancy provided such replacement is in accordance with the Mys Living tenancy assignment policy.
- Dual Occupancy
Some of our rooms are permitted to be booked for Dual Occupancy – this means two people sharing a room and the facilities available. Please note that we do not have any twin rooms.
Any additional charges associated with booking a room for Dual Occupancy will be set out in the booking process and may vary by property.
- Room Allocations Process
Room allocations will be carried out in a fair and transparent manner, taking into consideration availability, booking date, and any specific accommodation requirements disclosed by the resident.
Application Screening
You give us express consent to use the details provided by you to undertake:
- searches against sanctions lists, including those maintained by the United Kingdom, the United States, the European Union (“Sanctions Lists”); and
- background checks, including but not limited to searches against United Kingdom law enforcement databases (“Law Enforcement Databases”),
(“Screening Searches”).
You acknowledge that we may need to request additional information to verify your identity in connection with the Screening Searches (“Screening Search Additional Information Request”). You agree to cooperate with any Additional Information Request(s).
The undertaking of Screening Searches and/or any associated Screening Search Additional Information Request(s) will not affect your rights and/or our obligations to you under the Data Protection Act 2018.
You have the right to ask us not to undertake Screening Searches but in doing so we will not be able to progress your application.
mys Living Booking Incentive Terms and Conditions

General Conditions
1.1. These terms and conditions (“Terms”) apply to all promotional incentives (“Incentives”) offered by mys Living (“mys”, “we”, “us”, “our”) to residents who book accommodation at any mys Living property.
1.2. Incentives are subject to availability and may be withdrawn or amended by mys Living at any time without prior notice.
1.3. Incentives are non-transferable, non-exchangeable, and cannot be substituted for cash (unless otherwise stated).
1.4. Each incentive is available only to residents who:
Have completed a valid booking directly with mys Living or through an approved partner.
Have paid all rent due and are not in arrears at the time the incentive is issued.
Have submitted all required documentation prior to check-in (including identification, guarantor, and payment details where applicable).
1.5. Incentives are valid only for the academic year or promotional period specified.
1.6. If any code or claim for an incentive is made after the published expiry date, mys Living reserves the right to refuse the incentive.

Cashback Incentive
2.1. Eligible residents will receive a fixed cash amount as advertised at the time of booking.
2.2. Cashback will be paid after completion of the first full month of residence.
2.3. Payment will be made via UK bank transfer only to the resident’s nominated UK bank account.
2.4. To qualify, the resident must:
- Have completed one full month’s stay;
- Not be in rent arrears; and
- Have submitted all required documentation.
2.5. Cashback cannot be transferred, exchanged, or used as a rent offset.

Tram Pass (Nottingham Only)
3.1. Eligible residents in Nottingham will receive a pre-paid tram pass for use on the local tram network.
3.2. Following check-in, you will receive a communication from mys Living confirming that your incentive is ready for collection. This notification will include full details of the collection location and process. Please note that you will be required to sign upon collection to confirm receipt of your incentive.
3.3. To qualify, the resident must have submitted all required documents and must not be in arrears on rent.
3.4. The tram pass offer is subject to limited availability.
3.5. If a booking code or promotional link is used after the expiry of the offer, mys Living reserves the right to refuse the incentive.

Frive Meal Voucher
4.1. Eligible residents will receive a digital meal voucher of the advertised value, issued following check-in.
4.2. To qualify, the resident must have submitted all required documents and must not be in arrears on rent.
4.3. The meal voucher is subject to limited availability.
4.4. If a booking code or promotional link is used after the expiry of the offer, mys Living reserves the right to refuse the incentive.

Meadowhall Shopping Voucher (Sheffield Only)
5.1. Eligible residents in Sheffield will receive a Meadowhall Shopping Centre gift card of the advertised value.
5.2. The voucher will be issued on a click-and-collect basis and must be collected in person from Meadowhall Shopping Centre within four (4) weeks of check-in.
5.3. Following check-in, you will receive a communication from mys Living confirming that your incentive is ready for collection. This notification will include full details of the collection location and process. Please note that you will be required to sign upon collection to confirm receipt of your incentive.
5.4. The resident must present valid photo ID and their unique mys booking ID number at collection from Meadowhall Shopping Centre.
5.5. If the voucher is not collected within four (4) weeks, it will be voided.
5.6. To qualify, the resident must have submitted all required documents and must not be in arrears on rent.
5.7. The voucher is subject to limited availability and cannot be exchanged for cash or any other item.
5.8. If a booking code or promotional link is used after expiry, mys Living reserves the right to refuse the incentive.

mys Welcome Pack
6.1. Eligible residents will receive a welcome pack consisting of a kitchen and bedding set, issued following check-in.
6.2. To qualify, the resident must have submitted all required documents and must not be in arrears on rent.
6.3. The welcome pack is subject to limited availability and not exchangeable for cash or alternative items.
6.4. If a booking code or promotional link is used after expiry, mys Living reserves the right to refuse the incentive.
6.5. Following check-in, you will receive a communication from mys Living confirming that your incentive is ready for collection. This notification will include full details of the collection location and process. Please note that you will be required to sign upon collection to confirm receipt of your incentive.

Ocean Bottle
7.1. All bookers will receive a mys Living Ocean Bottle upon arrival.
7.2. The Ocean Bottle is not exchangeable and cannot be substituted or exchanged for cash or other items.
7.3. Following check-in, you will receive a communication from mys Living confirming that your incentive is ready for collection. This notification will include full details of the collection location and process. Please note that you will be required to sign upon collection to confirm receipt of your incentive.

Refer a Friend Incentive
8.1. Eligible residents who refer a friend to mys Living will receive a fixed cash incentive as advertised at the time of the offer.
8.2. Payment will be made after completion of the referred friend’s first full month of residence.
8.3. Payment will be made via UK bank transfer only to the referring resident’s nominated UK bank account.
8.4. To qualify, both the referring resident and the referred friend must:
Have submitted all required documentation; and
Not be in rent arrears at the time the payment is due.
8.5. The referred friend must provide the unique student ID number of the existing resident when requested by the mys Living team to validate the referral.
8.6. If the referral information is not provided at the time of booking confirmation, mys Living reserves the right to refuse the incentive payment.
8.7. The Refer a Friend incentive is non-transferable and cannot be combined with any other referral or promotional offer.

Additional Terms
9.1. mys Living reserves the right to withdraw or amend any incentive offer at any time without notice.
9.2. mys Living accepts no responsibility for lost, stolen, or uncollected vouchers, passes, or packs once issued.
9.3. Incentives are provided as goodwill gestures and form no part of the contractual rent or tenancy agreement.
9.4. In the event of any dispute, the decision of mys Living management is final.
9.5. These Terms shall be governed by and construed in accordance with the laws of England and Wales.
