Booking Terms and Conditions – England and Wales
1. Purpose
This policy sets out the payments required to Mys Living in order to secure a booking at one of our properties and the process to complete this booking.
Our aim is always to be clear and transparent about how to book a room with us, the costs involved and the circumstances where either you or we can cancel a booking.
2. Scope
2.1. This policy applies to all bookings relating to buildings in:
- England
- Wales
2.2. Mys Living’s Tenancy Agreement sets out the full terms and conditions applicable during the tenancy period. The Tenancy Agreement is a legally binding document – if you do not understand these terms and conditions or the Tenancy Agreement, we advise you to seek advice before accepting your booking with us.
2.3. A separate policy and arrangements exist for rooms in buildings located in Scotland.
3. Required Payments at Time of Booking
3.1. In order to book a room with Mys Living, a Holding Deposit is required which will not exceed 1 week’s rent.
3.2. If you have paid a Holding Deposit, this will be treated as a payment towards your first rental payment and credited to your rent account upon check-in.
4. Booking Deadline
4.1. The Booking Deadline is 7 days after the commencement of your booking.
4.2. Your Booking must be completed in full, including payment of the Holding Deposit and acceptance of the Tenancy Agreement and Guarantor Documents where required.
4.3. Failure to complete your Booking within this timescale may result in your Booking being cancelled and your Holding Deposit being retained by us.
4.4. Mys Living reserves the right to reduce this Booking Deadline at its discretion; in all cases the deadline will be notified to you prior to your Booking being cancelled.
5. Cancellation of Your Booking by Mys Living
5.1. Mys Living may cancel your Tenancy Agreement subject to any of the following circumstances:
a) We take all reasonable steps to enter into the Tenancy Agreement before the Booking Deadline and you fail to do so or the Booking Deadline has passed (for example, if you fail to complete your application or provide guarantor details (if applicable) and supporting documentation);
b) We believe that you have provided us with relevant false or misleading information;
c) We are prohibited from entering into the Tenancy Agreement with you because of the Immigration Act 2014 (persons disqualified by immigration status). Should we cancel your booking for this reason, you will not be liable for the contractual obligations laid out in the Tenancy Agreement from the date of cancellation, irrespective of whether you have signed it;
d) You or your guarantor (if applicable) fail to cooperate with any Screening Search Additional Information Request(s) or we have determined following undertaking Screening Searches that you or your guarantor (if applicable) appear on Sanctions Lists and/or Law Enforcement Databases;
e) You have not paid any amounts that have fallen due (including but not limited to, your first rental instalment, any previous year’s rent or damage charges);
f) You have committed any breach of the Tenancy Agreement or any previous tenancy agreement with us.
5.2 Cooling Off Period
a)Unless you have already collected the keys to the accommodation, you may cancel your booking by emailing the site team, at any time during the 7 days after we send you an e-mail confirming your booking is complete (the “7 Day Cooling-Off Period”). If you do that, you will not be charged and we will return your deposit or any Advance Rent Payments you have made.
b)Once the 7 Day Cooling-Off-Period has expired, you will have to pay all amounts due under your Tenancy Agreement unless a suitable replacement Tenant is found and accepted by us for your Room in accordance with this policy, or you enter a new Tenancy with Mys Living.
6. Cancellation of Your Booking by You Prior to Your Tenancy Start Date
(No Place No Pay Guarantee)
6.1. Mys Living offers a guarantee that if you do not take up your place at your chosen University, you may be released from your Booking and your obligations under the Tenancy Agreement, subject to the following conditions being met:
a) You are unsuccessful in gaining a place at your chosen University due to failure to obtain the required grades;
b) You are unsuccessful in obtaining a required visa to study at your chosen University;
c) Written evidence of the relevant outcome (for example, an official letter or email from the University or placement provider) is provided within 5 days of you receiving it; and
d) Your cancellation request is reviewed and formally accepted by Mys Living, confirming that your liability under the Tenancy Agreement has been lifted.
6.1.2 In such cases, your Holding Deposit will be refunded in accordance with our refunds policy.
6.1.3 Where Mys Living cannot verify the authenticity of the evidence provided, we reserve the right to reject the request and enforce the terms and conditions of the Tenancy Agreement in full.
6.1.4 If you wish to cancel your Booking for any reason not listed above, or if your request is not accepted by us, you will remain responsible for all terms and conditions of the Tenancy Agreement.
6.1.5 In certain circumstances, it may be possible to find a replacement tenant to take over your agreement obligations. This will be managed in accordance with the Mys Living tenancy assignment policy.
(No Placement No Pay Guarantee)
6.2. Mys Living offers a No Placement, No Pay guarantee whereby, if your course of study requires the completion of a placement year and you are unsuccessful in securing a required, university-approved placement, you may be released from your booking, subject to the following conditions being met:
a) The placement forms a compulsory or formally recognised part of your course of study;
b) You are unsuccessful in securing a placement approved by your university or college for the relevant academic year or where a placement is secured but is subsequently confirmed to be at a location that is not reasonably commutable from the accommodation you have booked;
c) The placement would have taken place during the academic year covered by your Tenancy Agreement,
d) Written evidence is provided confirming that a placement has not been secured or that the placement location has been changed, such evidence to be issued by your university or college;
e) All supporting evidence is submitted within five (5) days of you receiving official confirmation; and
f) Your cancellation request is reviewed and formally accepted by us, confirming that your liability under the Tenancy Agreement has been released.
6.2.2 For the purposes of this guarantee, a placement will be considered reasonably commutable where the placement location can be reached within one (1) hour each way by public transport from the booked accommodation. Where a placement is deemed to be reasonably commutable, you will be expected to proceed with your Booking, and this guarantee will not apply. Any assessment of commute time, transport routes, and whether a placement is reasonably commutable will be determined by us, acting reasonably.
6.2.3 Where a placement was originally offered at a reasonably commutable location but is later confirmed to have moved to a location that is not reasonably commutable, this guarantee may apply, subject to the criteria above and the provision of appropriate written evidence.
6.2.4 Where a cancellation is accepted under this guarantee, any holding deposit or advanced rent paid will be refunded in accordance with our refunds policy.
6.2.5 Where we are unable to verify the authenticity, accuracy, or validity of the evidence provided, we reserve the right to reject the request and enforce the terms and conditions of the Tenancy Agreement in full.
6.2.6 This guarantee applies only in the circumstances set out above. If you wish to cancel your Booking for any other reason, or if your request is not accepted, you will remain responsible for all obligations under the Tenancy Agreement.
6.2.7 In certain circumstances, it may be possible to identify a replacement tenant to take over the obligations of the Tenancy Agreement. Any such arrangement should be discussed with the General Manager of the accommodation you have booked.
7. Requests to Cancel Your Tenancy After the Tenancy Start Date
7.1 General Position
Once your Tenancy Start Date has passed, you remain responsible for complying with your Tenancy Agreement, including payment of Rent, for the agreed tenancy period unless:
- you are entitled to end the Tenancy Agreement under the circumstances set out in this section;
- Mys Living agrees to release you from the Tenancy Agreement; or
- an approved replacement tenant takes over your tenancy in accordance with our tenancy assignment process.
Moving out of the accommodation, returning your keys or ceasing to attend your course does not, by itself, end your tenancy or your liability under the Tenancy Agreement.
Unless expressly stated otherwise in this policy, all approved releases under this section are subject to a minimum four weeks’ written notice.
7.2 Withdrawal, Exclusion or Refusal of Admission
You may end your Tenancy Agreement where, after entering into the Tenancy Agreement, you:
- withdraw from your course or institution;
- are excluded from your course or institution; or
- are refused admission to your institution of study.
You must provide Mys Living with:
- written notice confirming that you wish to end your tenancy and your intended date of departure; and
- written confirmation from your university, college or other educational institution confirming your withdrawal, exclusion or refusal of admission.
You must give Mys Living at least four weeks’ written notice.
Your supporting evidence must be provided at the time you give notice and must be reasonably satisfactory to Mys Living.
If there is a defect or omission in your notice or supporting evidence, Mys Living will notify you as soon as reasonably practicable and provide you with a reasonable opportunity to correct it.
You must vacate the accommodation on or before the departure date stated in your notice.
7.3 Suspension of Studies Due to Illness
You may end your Tenancy Agreement where:
- you have been absent from your course for more than 60 days due to illness; and
- you have agreed with your university, college or other higher education provider to suspend your studies.
You must provide:
- at least four weeks’ written notice confirming that you wish to end your tenancy and your intended date of departure; and
- written confirmation from your educational institution confirming that your studies have been suspended due to illness.
The supporting evidence must be provided at the time you give notice and must be reasonably satisfactory to Mys Living.
We would not normally require detailed medical records or information concerning your diagnosis where your educational institution has provided sufficient confirmation of the suspension.
If there is a defect or omission in your notice or supporting evidence, Mys Living will notify you as soon as reasonably practicable and provide you with a reasonable opportunity to correct it.
You must vacate the accommodation on or before the departure date stated in your notice.
7.4 Evidence Requirements
All requests must be made in writing to the General Manager or other contact specified by Mys Living.
Evidence must be reasonably satisfactory to Mys Living and should normally be provided in English. Where original evidence is not in English, we may request an English translation where reasonably necessary to assess the request.
Where appropriate, evidence may include:
- a letter or email from your university, college or educational institution;
- confirmation of withdrawal, exclusion, refusal of admission or suspension of studies;
- appropriate evidence from a medical professional;
- a death certificate or other evidence of bereavement where reasonably required;
- evidence from a relevant public body, professional or recognised support organisation; or
- other independent documentation reasonably relevant to the circumstances.
Mys Living may contact the organisation or institution which provided supporting evidence where reasonably necessary to confirm its authenticity, subject to applicable data protection requirements.
Where Mys Living is unable to verify the authenticity of evidence provided, or has reasonable grounds to believe that evidence is inaccurate, altered or not genuine, we may request further or alternative evidence. Where satisfactory evidence is not subsequently provided, Mys Living reserves the right to reject the request and the Tenant will remain responsible for complying with the Tenancy Agreement in full.
We recognise that some circumstances may involve particularly sensitive personal information. We will not request information which is unnecessary to determine the request and will consider reasonable alternative forms of evidence where appropriate.
7.5 Notice Period and Ongoing Liability
Unless otherwise expressly stated, a four-week notice period applies to all releases approved under this section.
During the notice period you remain responsible for all obligations under the Tenancy Agreement, including payment of Rent.
For releases under sections 7.2 and 7.3, the four-week notice period will run from the date on which Mys Living receives:
- valid written notice stating your intended departure date; and
- reasonably satisfactory supporting evidence.
You must vacate the accommodation and return all keys, access cards and other Mys Living property on or before the agreed departure date.
Rent and any other charges will remain payable up to and including the date on which the tenancy ends.
7.6 Replacement Tenant
If you do not qualify for release under this section, you may still seek a replacement tenant to take over your tenancy in accordance with the Mys Living tenancy assignment policy.
Any proposed replacement tenant must meet Mys Living’s eligibility and booking requirements and enter into the required tenancy documentation.
You will remain responsible for your existing Tenancy Agreement until the replacement tenancy has been completed and Mys Living has confirmed your release in writing.
Where a replacement tenant’s tenancy commences before the end of an otherwise applicable four-week notice period, Mys Living will not charge Rent to both the outgoing and replacement tenant for the same room and period.
7.7. Death of a Tenant or Future Tenant
7.7.1 Ending the Tenancy
Where a Tenant or Future Tenant dies after entering into the Tenancy Agreement and before the end of the tenancy period, that individual’s obligations under the Tenancy Agreement will end on the date of death.
The four-week notice requirement contained within section 7 does not apply.
Any guarantee relating specifically to the deceased Tenant’s obligations will also end on the date of death.
7.7.2 Outstanding Amounts
Mys Living will not pursue Rent, fees or other liabilities owed by the deceased Tenant which accrued before but remained unpaid at the date of death.
Where the Tenancy Agreement is held jointly with other tenants, this provision applies only to the proportion of the Rent and other obligations which can reasonably be attributed to the deceased Tenant.
7.7.3 Rent Paid in Advance
Any Rent or applicable fee paid by the deceased Tenant in advance for a period after the date of death will be refunded on a daily apportioned basis.
Mys Living will work sensitively with the Tenant’s family, representative or estate to arrange the return of possessions and completion of any necessary practical arrangements.
8. Dual Occupancy
8.1. Some of our rooms are permitted to be booked for Dual Occupancy – this means two people sharing a room and the facilities available.
8.2. Please note that we do not have any twin rooms.
8.3. Any additional charges associated with booking a room for Dual Occupancy will be set out in the booking process and may vary by property.
9. Room Allocations Process
9.1. Room allocations will be carried out in a fair and transparent manner, taking into consideration availability, booking date, and any specific accommodation requirements disclosed by the resident.
10. Application Screening
10.1. You give us express consent to use the details provided by you to undertake:
a) Searches against sanctions lists, including those maintained by the United Kingdom, the United States, and the European Union (“Sanctions Lists”); and
b) Background checks, including but not limited to searches against United Kingdom law enforcement databases (“Law Enforcement Databases”),
(together referred to as “Screening Searches”).
10.2. You acknowledge that we may need to request additional information to verify your identity in connection with the Screening Searches (“Screening Search Additional Information Request”).
10.3. You agree to cooperate with any Additional Information Request(s).
10.4. The undertaking of Screening Searches and/or any associated Screening Search Additional Information Request(s) will not affect your rights and/or our obligations to you under the Data Protection Act 2018.
10.5. You have the right to ask us not to undertake Screening Searches but in doing so we will not be able to progress your application.
mys Living Booking Incentive Terms and Conditions
11. General Conditions
11.1. These terms and conditions (“Terms”) apply to all promotional incentives (“Incentives”) offered by mys Living (“mys”, “we”, “us”, “our”) to residents who book accommodation at any mys Living property.
11.2. Incentives are subject to availability and may be withdrawn or amended by mys Living at any time without prior notice.
11.3. Incentives are non-transferable, non-exchangeable, and cannot be substituted for cash (unless otherwise stated).
11.4. Each incentive is available only to residents who:
a) Have completed a valid booking directly with mys Living or through an approved partner;
b) Have paid all rent due and are not in arrears at the time the incentive is issued;
c) Have submitted all required documentation prior to check-in (including identification, guarantor, and payment details where applicable).
11.5. Incentives are valid only for the academic year or promotional period specified.
11.6. If any code or claim for an incentive is made after the published expiry date, mys Living reserves the right to refuse the incentive.
12. Cashback Incentive
12.1. Eligible residents will receive a fixed cash amount as advertised at the time of booking.
12.2. Cashback will be paid after completion of the first full month of residence.
12.3. Payment will be made via UK bank transfer only to the resident’s nominated UK bank account.
12.4. To qualify, the resident must:
a) Have completed one full month’s stay;
b) Not be in rent arrears; and
c) Have submitted all required documentation.
12.5. Cashback cannot be transferred, exchanged, or used as a rent offset.
13. Tram Pass (Nottingham Only)
13.1. Eligible residents in Nottingham will receive a pre-paid tram pass for use on the local tram network.
13.2. Following check-in, you will receive a communication from mys Living confirming that your incentive is ready for collection, including full details of the collection location and process. You will be required to sign upon collection to confirm receipt.
13.3. To qualify, the resident must have submitted all required documents and must not be in arrears on rent.
13.4. The tram pass offer is subject to limited availability.
13.5. If a booking code or promotional link is used after the expiry of the offer, mys Living reserves the right to refuse the incentive.
14. Free Laundry Offer (The Vantage, Nottingham Only)
14.1. Eligible residents booking a room at The Vantage, Nottingham will receive 1 year of free laundry facilities (36 washes & 36 Dry) as part of this promotional offer.
14.2. Following check-in, you will receive a communication from mys Living confirming that your free laundry incentive has been activated, including full details of how to access and use the laundry facilities.
14.3. To qualify, the resident must have submitted all required documents and must not be in arrears on rent.
14.4. The free laundry offer will commence from the resident’s tenancy start date and is non-transferable, non-exchangeable, and cannot be redeemed for cash or any alternative incentive.
14.5. This offer is valid on all bookings at The Vantage, Nottingham made from the date of publication of this offer until 30 June 2026. mys Living reserves the right to amend or withdraw the offer at any time.
14.6. If a booking code or promotional link is used after the expiry of the offer period, mys Living reserves the right to refuse the incentive.
15. Frive Meal Voucher
15.1. Eligible residents will receive a digital meal voucher of the advertised value, issued following check-in.
15.2. To qualify, the resident must have submitted all required documents and must not be in arrears on rent.
15.3. The meal voucher is subject to limited availability.
15.4. If a booking code or promotional link is used after the expiry of the offer, mys Living reserves the right to refuse the incentive.
16. Meadowhall Shopping Voucher (Sheffield Only)
16.1. Eligible residents in Sheffield will receive a Meadowhall Shopping Centre gift card of the advertised value.
16.2. The voucher will be issued on a click-and-collect basis and must be collected in person from Meadowhall Shopping Centre within four (4) weeks of check-in.
16.3. Following check-in, you will receive a communication from mys Living confirming that your incentive is ready for collection, including full details of the collection location and process. You will be required to sign upon collection to confirm receipt.
16.4. The resident must present valid photo ID and their unique mys booking ID number at collection.
16.5. If the voucher is not collected within four (4) weeks, it will be voided.
16.6. To qualify, the resident must have submitted all required documents and must not be in arrears on rent.
16.7. The voucher is subject to limited availability and cannot be exchanged for cash or any other item.
16.8. If a booking code or promotional link is used after expiry, mys Living reserves the right to refuse the incentive.
17. mys Welcome Pack
17.1. Eligible residents will receive a welcome pack consisting of a kitchen and bedding set, issued following check-in.
17.2. To qualify, the resident must have submitted all required documents and must not be in arrears on rent.
17.3. The welcome pack is subject to limited availability and not exchangeable for cash or alternative items.
17.4. If a booking code or promotional link is used after expiry, mys Living reserves the right to refuse the incentive.
17.5. Following check-in, you will receive a communication from mys Living confirming that your incentive is ready for collection, including full details of the collection location and process. You will be required to sign upon collection to confirm receipt.
18. Ocean Bottle
18.1. All bookers will receive a mys Living Ocean Bottle upon arrival.
18.2. The Ocean Bottle is not exchangeable and cannot be substituted or exchanged for cash or other items.
18.3. Following check-in, you will receive a communication from mys Living confirming that your incentive is ready for collection, including full details of the collection location and process. You will be required to sign upon collection to confirm receipt.
19. Refer a Friend Incentive
19.1. Eligible residents who refer a friend to mys Living will receive a fixed cash incentive as advertised at the time of the offer.
19.2. Payment will be made after completion of the referred friend’s first full month of residence.
19.3. Payment will be made via UK bank transfer only to the referring resident’s nominated UK bank account.
19.4. To qualify, both the referring resident and the referred friend must:
a) Have submitted all required documentation; and
b) Not be in rent arrears at the time the payment is due.
19.5. The referred friend must provide the unique signature ID number of the existing resident at the point of enquiry to validate the referral
19.6. If the referral information is not provided at the time of booking confirmation, mys Living reserves the right to refuse the incentive payment.
19.7. The Refer a Friend incentive is non-transferable and cannot be combined with any other referral or promotional offer.
20. Additional Terms
20.1. Mys Living reserves the right to withdraw or amend any incentive offer at any time without notice.
20.2. Mys Living accepts no responsibility for lost, stolen, or uncollected vouchers, passes, or packs once issued.
20.3. Incentives are provided as goodwill gestures and form no part of the contractual rent or tenancy agreement.
20.4. In the event of any dispute, the decision of Mys Living management is final.
20.5. These Terms shall be governed by and construed in accordance with the laws of England and Wales.
21. #Staybetterwithmys
21.1 Eligibility
Open to current Mys living residents and students only.
21.2 How to Enter
Create and share original “day-in-the-life” content showcasing your experience at Mys living Entries must tag your MYS home and @we_are_mys as a collaborator, and include the hashtag #StayBetterWithmys.
21.3 Deadline
All content must be created and posted by 10th May 2026.
21.4 Reward
Eligible students who create and publish qualifying content in accordance with these terms will be automatically entered into a competition. Prizes include one £100 Amazon Gift Card, two £50 Amazon Gift Cards, and two £25 Amazon Gift Cards. Winners will be selected at random from all eligible entries.
21.5 Content Usage
By entering, you grant Mys living permission to use your submitted content on social media, marketing materials, and other promotional platforms, with credit where possible.
21.6 Behaviour and Disqualification
Entries must be appropriate, respectful, and original. Mys living reserves the right to remove and disqualify any content that is offensive, plagiarised, infringes copyright, or portrays MYS negatively. Any negative content will be removed and the resident’s entry will not be counted.
21.7 Privacy
Any personal information provided will only be used for competition purposes and will not be shared with third parties.
21.8 Changes and Cancellation
Mys living reserves the right to amend or cancel the campaign at any time.
22. Instagram Competition Terms & Conditions
22.0 Open to current residents for the 2026/27 academic year only.
22.1 To enter: follow our page, like the competition post, and tag 3 friends.
22.2 Competition closes 10 September 2026.
22.3 One winner will be selected at random and contacted via Instagram DM.
22.4 Prize: 1 × Instax Mini 12 Camera. No cash alternative available.
22.5 If the winner does not respond within 7 days, an alternative winner may be selected.
22.6 This competition is not sponsored, endorsed, or administered by Instagram.
22.7 By entering, you agree to these Terms & Conditions.
23. A Level Results Special Offer
23.1 Promotional Period
The A Level Results Special Offer is valid for eligible bookings made between 00:00 13 August 2026 and 23:59 24 August 2026 at The Vantage and Luxurio and between 00:00 13 August 2026 and 23:59 31 August 2026 at Steel City and Hythe Mills.
23.2 Offer
Eligible students who make a qualifying booking during the promotional period will receive a reduction of £10 per week from the weekly advertised rate at the time of booking. This will be applied directly to the booking as a rate reduction and no further discount will be made or added to the booking.
This offer is valid only on selected properties and room types within those properties – the offer will be clearly stated and applied to the booking where applicable.
23.3 Discount Calculation
The total discount will be calculated by multiplying £10 by the number of full weeks in the contracted tenancy. For example, a 51-week tenancy will receive a total discount of £510 (£10 × 51 weeks).
23.4 Eligibility
The offer is available to eligible students making a new booking during the promotional period, subject to availability and the applicable booking terms and conditions.
All other discount and cashback incentives advertised cannot be used in conjunction with this offer, however Tram, Vouchers and Laundry Credit may still be claimed in accordance with the relevant terms and conditions.
23.5 Application of Discount
The discount will be applied to the total accommodation cost for the contracted tenancy. The discount is based on the original contracted tenancy length and cannot be exchanged for cash or transferred to another booking.
23.6 Changes and Cancellation
Mys living reserves the right to amend, extend, withdraw, or cancel the Results Day Sale at any time.
23.Last Chance Sale
23.1 Promotional Period
The Last Chance Sale is valid for eligible bookings made between 03/09/26 and 30/09/26 at The Vantage and Luxurio Steel City and Hythe Mills.
23.2 Offer
Eligible students who make a qualifying booking during the promotional period will receive a reduction of £10 per week from the weekly advertised rate at the time of booking. This will be applied directly to the booking as a rate reduction and no further discount will be made or added to the booking.
This offer is valid only on selected properties and room types within those properties – the offer will be clearly stated and applied to the booking where applicable.
23.3 Discount Calculation
The total discount will be calculated by multiplying £10 by the number of full weeks in the contracted tenancy. For example, a 51-week tenancy will receive a total discount of £510 (£10 × 51 weeks).
23.4 Eligibility
The offer is available to eligible students making a new booking during the promotional period, subject to availability and the applicable booking terms and conditions.
All other advertised discounts cannot be used in conjunction with this offer; however, cashback incentives, Tram, Vouchers, and Laundry Credit may still be claimed in accordance with the relevant terms and conditions.
23.5 Application of Discount
The discount will be applied to the total accommodation cost for the contracted tenancy. The discount is based on the original contracted tenancy length and cannot be exchanged for cash or transferred to another booking.
